Data Protection
What is it?
The Data Protection Act 1998 came into force on 1st March 2000 and
introduced a number of changes to the 1984 legislation. The Act
is enforceable against all data controllers regardless of whether
the activity has to be registered. Individuals must normally give
their consent to the processing, unless it is necessary for
the performance of a contract, there is a legal obligation or it
is for the legitimate interests of the data controller.
Data Protection is concerned with personal data (defined as
information about living, identifiable individuals) which is
automatically processed. It does not need to be particularly sensitive
information and can be as little as a name and address.
The Data Protection Principles provide for individuals to have access
to data held about themselves and, where appropriate, to have the
data corrected or deleted. If breaches of the principles have taken
place, enforcement action can be taken against the data user who may
in turn, appeal to an independent tribunal. If the enforcement action
is upheld, failure to comply becomes a criminal offence.
Anyone who holds personal data about living individuals must register
unless covered by one of the exemptions provided under the legislation.
Registration may not be necessary where the data is:
- Held in connection only with personal, domestic or household affairs
(including recreational purposes).
- Held by a not for profit making organisation (eg a sports or
recreational club, voluntary organisation or certain charities).
- Used for internal business purposes (eg staff administration,
wages and pensions, keeping accounts and records of sales etc).
- Used for core business purposes (eg advertising, marketing and
public relations for own goods and services, but excluding data
controllers whose business is the provision of advertising, marketing
or PR).

Privacy
